Terms and Conditions

1. The Entity

1.1 This website is owned and operated by North Pier Pty Ltd, trading as the Frogs Hollow Brewing Company.

1.2 By using this web site or by placing an order through this web site you accept these Terms and Conditions. These Terms and Conditions may be updated from time to time and customers are advised to check them periodically.

2. Payment

2.1 We accept by payment by Visa or MasterCard only.

2.2 We do not accept American Express, Diners Cards, PayPal, AfterPay (or similar) nor will we accept payment over the phone.

2.3 Orders placed via our web site are processed by our credit card merchant provider Stripe.

2.4 We do not charge a credit card processing fee on any transactions.

3. Pricing

3.1 Prices are in Australian dollars (AUD) and include GST (Goods and services tax).

3.2 All prices displayed exclude delivery costs.

3.3 Whilst we endeavour to ensure that all prices displayed on the web site are correct, it is possible that a product may be displayed with the incorrect price.

i. In the event that the displayed price is higher than the correct price, we will make the necessary adjustment and issue the customer with a refund equivalent to the difference between the displayed price and the correct price.

ii. In the event that the displayed price is lower than the correct price and noting that the customer has placed an order in good faith, we will not charge any additional costs to the customer if the difference is less than 10%. If the difference is greater than 10%, we will contact the customer and attempt to resolve the issue in an amicable manner with the view to reaching mutual agreement by both parties. Where mutual agreement cannot be achieved, we will cancel the order and provide a full refund to the customer.

4. Shipping

4.1 We only ship to locations in Australia – we do not ship internationally.

4.2 We use Australia Post to ship all of our products. We will not use other companies at the request of the customer.

4.3 Subject to stock levels, orders will be shipped within 48 hours. Where this is not possible we will contact the customer and provide an update on the issue.

4.4 The customer is responsible for ensuring the accuracy of the delivery address and the Frogs Hollow Brewing Company is not liable for lost shipments that are the result of an incorrect address.

4.5 Once a shipment has left our premises, it is not possible to redirect the shipment to another address.

4.6 Delivery times are out of our control and will vary depending on your location. We will provide you with a tracking number which will enable you to track and monitor the progress of your shipment.

4.6 Australia Post does allow for parcels to be left in a secure location if a signature cannot be obtained. Where it is not possible for the parcel to be left in a secure location, it will be available for pickup at your local post office.

4.7 Where a parcel cannot be delivered and the parcel is returned to us for whatever reason, we will contact the customer. Please not that we will not pay for any re-delivery costs.

4.8 It the delivery address is a workplace, please include the building name, floor or level and any special instructions needed to ensure that it is delivered.

4.9 For larger orders, the shipment may consist of multiple parcels which may not be delivered at the same time.

4.10 In the event that a parcel appears to have gone missing, customers should wait for 5 business days after the expected delivery date by Australia Post before lodging a missing parcel report by email to orders@frogshollowbrewingco.com.au. It can take up to 10 business days for Australia Post to investigate the missing parcel. If the parcel cannot be located after 10 business days, the customer will be offered a replacement shipment.

4.11 In the event that the parcel was left in a location provided by the customer and it was stolen, the Frogs Hollow Brewing Company reserves the right to not refund or reimburse you for the products ordered.

4.12 In the event that your parcel arrives in a poor condition or there is visible damage to the packaging, the customer should take 1 or more photos of the package which shows the damage before attempting to open the parcel. As the customer opens the package, if any items inside the parcel are damaged, they should take additional photo. The customer must notify the Frogs Hollow Brewing Company of any damage, including photos within 5 working days of the receipt of the parcel. If the customer does not contact us within 5 working days, or fails to provide photographic evidence of the damage, we reserve the right not to replace or refund the goods.

5. Local Pickup

5.1 We offer free local pickup to residents who live in the Bega Valley and surrounds. Please note that our system will offer this as an option to customers to have a delivery address with the following postcodes: 2537, 2545, 2546, 2548, 2549, 2550, 2551, 2628, 2630, 2631, 2632 & 3892.

5.2 If you are not in one of these postcodes and would like to pick your parcel up, please email orders@frogshollowbrewingco.com.au prior to placing your order and advise us of your postcode so that we can update our system.

6. Privacy Policy

6.1 Whilst the Frogs Hollow Brewing Company is not subject to the Australian Privacy Principles that form the foundations of the Commonwealth Privacy Act and not subject to the NSW Privacy and Personal Information Protection Act, we are committed to keeping your details confidential and we are committed to the spirit and intent of the Australian Privacy Principles. This includes:

i. Being open and transparent about why we need to collect personal information;

ii. Detailing how we intend to use any personal information that you provide or that we collect;

iii. Taking all of the necessary steps to ensure that your personal information is stored in a safe and secure manner;

iv. Not adding you to any email lists without your permission;

v. Not passing your information to any third parties without your permission and where it is necessary to share any information with other providers, only providing the minimum information required;

6.2 Any information we hold will be used to process your order and to personalise your shopping experience.

6.3 Please note that our website will use cookies to allow you to login to your account, maintain a shopping cart and to purchase items in your shopping cart. Cookies sent to your computer from us only last while you’re browsing our website. We do not store persistent cookies on your computer. Cookies also allow us to give you a more personalised shopping experience by displaying products that interest you throughout our product pages, thus providing you with a more friendly, interesting and enjoyable shopping experience.

6.4 Whenever you use our web site, or any other web site, the computer on which the web pages are stored (the Web server) needs to know the network address of your computer so that it can send the requested web pages to your Internet browser. The unique network address of your computer is called its “IP address,” and is sent automatically each time you access any Internet site. From a computer’s IP address, it is possible to determine the general geographic location of that computer, but otherwise it is anonymous.

6.5 We do not keep a record of the IP addresses from which users access our site except where you have specifically provided us with information about yourself, in which case we also record your IP address for security purposes. An example of this would be when proceeding to a checkout to finalise an order you may wish to make. After completing the form provided, your IP address will be stored along with a transaction number that allows us to track your order.
